Our Terms and Conditions
1. Definitions
1.1 “Buyer” means the individual or organisation who buys or agrees to buy the Goods from the Seller;
1.2 “Contract” means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
1.3 “Goods” means the articles that the Buyer agrees to buy from the Seller;
1.4 “Seller” means Unique Mobility Ltd, Head Office at Unit 2a Scarne Industrial Estate, Launceston, PL15 9HS, Including the branches at Plymouth & Exeter.
1.5 “Terms and Conditions” means the terms and conditions of sale set out in this document.
2. Conditions
2.1 Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a consumer.
2.2 These Terms and Conditions shall apply to all contracts for the Sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.3 Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.
3. Ordering
3.1 All orders require a non-refundable deposit of 50%. Cancellation of orders by the Buyer will result in the loss of the deposit to cover any expenses incurred by the Seller.
3.2 Any products that are specifically tailored to the individual and/or ordered in specifically for the Buyer are excluded from the cancellation policy including;
• Made to measure rise & recline chairs
• Prescription and Special order wheelchairs
• Prescription Power chairs and Cushions
• Products that the Buyer finds unsuitable but were advised against buying by the Seller.
3.3 If the Seller becomes aware of any error in the price or description of a product ordered, the Seller will notify the Buyer and give the Buyer the option to either continue with the order or cancel it.
3.4 The Buyer does not have the right to a cancelation period for purchases that are made on the premises of the shop and the contract will begin at the point the order is placed.
3.5 All orders for goods are subject to availability. If the Seller cannot supply the Goods, the Buyer will be informed of the situation and will not be charged for those Goods. Any monies already paid by the Buyer for the Goods will be refunded; however, the Seller will not be responsible for compensating the Buyer for any other losses, which may be suffered as a result of the Goods not being supplied.
4. Delivery Times
4.1 Goods supplied within the UK will normally be delivered within 30 days of receipt of order (many within 5 days). However, some specialist items are produced to order and it is advisable for the Buyer to contact the Seller before placing the order to obtain an approximate delivery date.
4.2 Delivery of the Goods shall be made to the Buyer’s address specified in the order.
4.4 Delivery to the UK only. The cost of delivery will depend on the size of the item to be delivered and distance to the delivery address. Please call 01752 546222 for prices and further information.
4.5 Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.
5. Cancellations, Refunds and Returns
5.1 Telephone and off premises purchases: If the Buyer is unhappy with the purchase for any reason the Goods can be returned, in an unused, new condition, within the original packaging, within 14 days of delivery for a full refund (less collection and delivery costs). The Buyer will provide a cancellation form for completion and refunds may take up to 2 weeks to be processed.
5.2 If the Buyer requires work to start immediately they must give explicit instructions to the seller as the normal cancellation rights do not apply and charges up to the point of cancelation will be charged.
5.3 Emergency repairs off premises are exempt from cancellation rights.
5.4 Items with a value of less than £10 are exempt from cancellation rights.
5.5 For reasons of hygiene and cross infection, the Seller’s returns policy does not extend to the following products:
• Mattresses, toppers, pillows and bedding
• Commodes
• Bath lifts

5.6 We do not accept returns or offer refunds for purchases made in the showroom unless faulty, if a product is faulty we have the right to repair or replace the item before a refund is offered. Once products have been paid for in full or a deposit has been paid there are no rights to return the item for a refund, credit note or exchange. All deposits are non-refundable once a product or accessories have been ordered we are unable to offer a refund; credit note or exchange regardless of whether we have handed over the product or not.
6. Faulty/Damaged Goods
6.1 The Buyer shall inspect the Goods immediately upon receipt and shall state on the documentation details of damage to either the packaging or the goods before signing for them. Where this is not done, the Seller will not be responsible for the costs associated with repair or replacement. In all cases damage to goods should be reported to the Seller by phone on 01752 546222 within 24 hours of delivery. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods. All products leave the Seller in a new condition. Please check items before signing. Please do not accept goods if they are damaged and return them immediately.
7. Warranty Policy
7.1 The Seller is an official dealer for all of the products supplied and offer the Goods with the normal manufacturer’s parts warranty, typically 12 months, subject to the exclusions detailed below.
7.2 In addition, for purchases made in store for all major mobility products i.e mobility scooters, power-chairs, rise-recliners, bath lifts the seller will also cover the labour costs associated with the repairs under the warranty for 12 months regardless of the parts warranty offered by the manufacturer, subject again to exclusions below. Products that have extended parts warranty of up to 5 years by the manufacturer will not include labour or call out costs which will have to be met by the buyer. Where problems do occur, the Seller will normally look to repair the product on site but in some circumstances may arrange for the item to be returned for repair.
7.3 Repairs under the warranty will only be carried out within the Devon and Cornwall area.
7.4 General warranty exclusions:
• Parts which need adjustment, re-setting, replacement or repair due to abuse, fair wear & tear or to suit the individual needs of the user i.e. tyres, lap belts, bulbs, plastic shrouds and upholstery (damaged post receipt), motor brushes, normal battery degradation, wheelchair brake adjustment, circuit breaker resetting, resetting user-induced problems on riser-recliners - cleared by disconnecting/re-connecting hand control etc. Where call-outs occur for such items the purchaser will remain liable for the call-out, parts and labour costs. However, the Seller will do its utmost to minimise these by talking through problems in depth before arranging to visit. Experience shows that many problems can be attributable to a lack of user familiarity and can often be overcome with some simple fault diagnosis and guidance over the phone.
• Damage attributable to misuse or accident for which the Seller cannot be deemed responsible.
8. Price and Payment
8.1 The price of the Goods shall be as stated and are advertised/displayed excluding VAT where applicable for qualifying persons.
8.2 VAT exemption will only apply if a declaration is completed and signed
9. Rights of the Seller
9.1 The Seller reserves the right to change the price of any item at its discretion.
10. Force Majeure
10.1 The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock-outs, accidents, war, fire or breakdown of plant or machinery and the Seller shall be entitled to a reasonable extension of its obligations.
11. Changes to Terms and Conditions
11.1 The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
12. Governing Law and Jurisdiction.
12.1 These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
